What Is HRA?

HRA Meaning

House Rent Allowance (HRA) is a salary component paid by an employer to help an employee cover their rental accommodation expenses, offering partial tax exemption under Section 10(13A) of the Income Tax Act, 1961, subject to specific conditions and calculation limits.

HRA Exemption Calculation Formula

The HRA exemption available is the lowest of the following three amounts: (1) actual HRA received from the employer, (2) rent paid minus 10% of basic salary (plus DA, if applicable), or (3) 50% of basic salary for employees in metro cities (Delhi, Mumbai, Kolkata, Chennai) or 40% of basic salary for non-metro cities.

Worked Example

Example

For an employee with a Basic Salary of ₹40,000/month, HRA received of ₹20,000/month, and actual rent paid of ₹18,000/month in a metro city: the exemption would be the lowest of ₹20,000 (actual HRA), ₹14,000 (₹18,000 rent − ₹4,000, i.e., 10% of basic), or ₹20,000 (50% of basic) — making the exempt HRA ₹14,000/month, with the remaining ₹6,000/month being taxable.

Documentation Required to Claim HRA Exemption

  • Valid rent receipts from the landlord
  • Landlord's PAN details, if annual rent exceeds ₹1,00,000
  • A registered rent agreement, recommended particularly for higher rent amounts or if requested by the employer/tax authorities

Can HRA Be Claimed Without Actually Paying Rent?

No, HRA exemption specifically requires the employee to have genuinely incurred rental expense; claiming HRA exemption without actually paying rent constitutes tax fraud and can result in penalties if detected during tax scrutiny or assessment.

HRA (House Rent Allowance): Frequently Asked Questions

Can an employee claim HRA exemption if living with parents and paying them rent?
Yes, this is generally permissible provided it is a genuine rental arrangement with proper documentation (rent receipts, and the parent declaring the rental income in their own tax return), though tax authorities scrutinize such arrangements more closely to ensure genuineness.
Is HRA available under the new tax regime?
The HRA exemption benefit is generally available only under the old tax regime; the new tax regime offers lower slab rates but does not permit most exemptions and deductions, including the HRA exemption, so employees should evaluate which regime is more beneficial for their specific situation.
