What Is Form 16B?
Form 16B is a TDS certificate specifically issued for tax deducted at source on the sale of immovable property, generated by the buyer of the property and provided to the seller, confirming that TDS was deducted and deposited on the property transaction value.
Why Form 16B Exists
Under Section 194-IA of the Income Tax Act, 1961, a buyer purchasing immovable property (other than agricultural land) valued at ₹50 lakh or more is required to deduct TDS at a specified rate on the transaction value and issue Form 16B to the seller as proof of this deduction.
Relevance to HR and Corporate Contexts
- While primarily a real estate transaction document rather than a core HR/payroll form, Form 16B becomes relevant in HR contexts when a company purchases property (office space, employee housing) and must comply with applicable TDS obligations.
- Finance and admin teams handling corporate real estate transactions need to be aware of this requirement to ensure compliance and provide the seller with the required certificate.
How Form 16B Is Generated
Similar to other TDS certificates, Form 16B is generated through the TRACES portal by the buyer after successfully depositing the TDS deducted on the property transaction, using Form 26QB for the actual TDS payment and subsequently downloading Form 16B as the certificate.
